1. Agreement to terms
By accessing or using ANKR at ankrproperties.com, app.ankrproperties.com, or through the Ankr Properties mobile app (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.
2. What ANKR provides
ANKR is a software platform that helps real estate owners, developers, and related parties organize deals, manage documents and budgets, submit draw requests, collaborate with lenders and partners, process certain payments, and verify construction progress in the field.
ANKR is not a bank, lender, broker, or legal advisor. We do not originate loans, guarantee funding, or provide legal, tax, or investment advice. You are solely responsible for your deals, financial decisions, and compliance with applicable laws.
3. Eligibility and accounts
To use the Services, you must:
- Be at least 18 years old and able to form a binding contract
- Provide accurate registration and profile information
- Maintain the security of your login credentials
- Notify us promptly of unauthorized account access
You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms or pose security or legal risk.
4. Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, or misleading purposes
- Upload false verification photos or misrepresent project progress
- Attempt to bypass location or camera controls in the mobile app
- Interfere with or disrupt the Services, servers, or networks
- Access data belonging to other users without authorization
- Reverse engineer, scrape, or misuse the Services except as permitted by law
- Upload malware or content that infringes third-party rights
5. Your content and data
You retain ownership of content you submit (documents, photos, financial information, and project data). You grant ANKR a limited license to host, process, display, and share that content as needed to operate the Services — including when you direct us to share draw files or document packages with lenders, contractors, or partners.
You represent that you have the rights to submit content and that doing so does not violate law or third-party agreements.
6. Sharing with lenders and third parties
When you generate share links or submit draw verification packages, you control what recipients can view. You are responsible for sharing only with intended parties and for the accuracy of information you provide to lenders and partners.
7. Payments
Certain invoice and payout features are processed through Stripe. By using payment features, you also agree to Stripe’s applicable terms. Fees, billing, and trial terms presented in the product at the time of purchase govern paid subscriptions or services.
ANKR does not store full payment card numbers. Payment disputes related to underlying construction or contractor work are between the relevant parties unless otherwise stated in a separate agreement.
8. Mobile app — draw verification
The mobile app requires live camera capture and location access for draw verification features. You agree to use these features only for legitimate project documentation. Attempts to falsify verification data may result in account suspension and reporting to affected parties.
9. SMS/text messaging (ANKR Text)
By providing and verifying a phone number through the app, you agree to receive SMS text messages from ANKR related to your account and projects, including verification codes, task and project notifications, and responses to questions you send by text (“ANKR Text”). Message frequency varies based on your account activity. Message and data rates may apply. You may opt out at any time by replying STOP, or request help by replying HELP. ANKR Text follows the SMS practices described in our Privacy Policy.
10. Intellectual property
ANKR, our logos, software, and design elements are owned by us or our licensors. These Terms do not grant you any right to use our trademarks except as needed to use the Services in the ordinary course.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANKR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL ALWAYS BE ACCURATE OR COMPLETE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANKR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, DEALS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO ANKR IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
14. Indemnification
You agree to indemnify and hold ANKR harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, your deals or transactions, or your violation of these Terms or applicable law.
15. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Services. Sections that by nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
16. Changes
We may modify these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use after changes become effective constitutes acceptance of the updated Terms.
17. Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory local law applies.
